Corporate Events & Hospitality Agreement

1. All bookings are subject to this Agreement and also to the entire current Center Parcs UK "Our Agreement With You".  Where there is conflict between these two agreements on specific terms, those contained in this Agreement shall apply.

2. In this Agreement, 'Center Parcs/us/we' means Center Parcs Limited, 'Center Parcs Village' means the Village specified on the Deposit Invoice and Contract,
'the Booking' means the reservation made by the Client with Center Parcs for various services such as corporate hospitality, accommodation and other facilities and activities, which may or may not lead to a Contract, 'the Client/you/your' means the individual, partnership or company making the Booking, 'the Contract' means the document including this Agreement (shown on the reverse) specifying, amongst other things, the following details:

(Please note that all preferences will not form part of your Contract until confirmed as accepted by Center Parcs in writing)
'the Deposit Invoice' means the Center Parcs invoice raised in respect of the Client's Booking based on provisional requirements and numbers.  
'the Final Invoice' means the Center Parcs and Center Parcs Energy Services Ltd invoices dispatched shortly after departure from the relevant village detailing the final payment due in respect of the completed Contract.

3. Booking Procedures

3.1 After initial discussions to establish your requirements, we will hold a provisional booking for your then identified requirements for 14 days.  Within that 14 day period, you must provide written details of all your requirements, including villas and/or apartments, or the provisional booking will lapse.  On receipt of your written Booking within the above timescale, we will issue a Deposit Invoice and a Contract.

3.2 Unless Clause 3.3 or 3.4 applies, a Booking is regarded as provisional and no Contract is formed until a Contract, signed by an authorised representative of the Client accepting responsibility for the Booking has been received, and payment of the Deposit Invoice has been cleared by Center Parcs as follows:

3.3 For Bookings made less than 21 days ahead of the relevant Booking start date our Contract will be formed when the debit or credit card payment is authorised and a signed Center Parcs Contract is received by Center Parcs.  Payment by cheque is not acceptable for such bookings, unless the cheque clears before the relevant Booking start date.

3.4 Should Center Parcs
(a) not require payment of a deposit within 14 days of receipt of your written Booking; or should you not pay your Deposit Invoice within the timescales required and Center Parcs continue with your Booking, then a Contract will be in place between us [14] days after receipt of your written Booking in respect of sub-clause (a) and [29] days after receipt of your written Booking in respect of sub-clause (b)

3.5 The deposit required to secure the Booking will be 50% of estimated costs.

3.6 Unless the provisions of clause 3.4 apply payment must be made to and accepted by Center Parcs as set out in Clause 3.2 within 28 days of issue of the Deposit Invoice and Contract or the facilities and villas booked will be released.

4. Numbers

When providing details and numbers, please ensure they are realistic and related to the entire duration of the Booking. At not less than 56 days prior to the Booking start date Center Parcs and the Client will agree the final estimated number of accommodation units required, the numbers of delegates and their guests, and the number of delegates attending specific functions and the extent and use of facilities and other services required.
Between 55 days and 14 days prior to the Booking start date any reduction of more than 10% in the final estimated numbers agreed above for accommodation units or delegates attending specific functions or their guests will be treated as cancellations. (see below).

From 14 days prior to the Booking start date, all alterations will be subject to the cancellation terms detailed below.
We require your final numbers, delegate and guest apartment/room lists, information on visitors and all function details (including but not limited to use of facilities and other services required) no later than 14 days prior to the Booking start date.

5. Cancellations

Up to and including 15 days prior to the Booking start date:
If you have to cancel or reduce your final estimated numbers by more than 10%, the following cancellation fees will apply:
Days Prior to Booking start date
More than 56 days - Cancellation Fee - 25% of Deposit Invoice value or where no deposit has been paid then 25% of the amount calculated in accordance with clause 3.4 above
29-56 days - Cancellation Fee - 50% of final estimated booking value
28-15 days - Cancellation Fee - 75% of final estimated booking value
14 days or less  - Cancellation Fee - 100% of final estimated booking value
In addition, the Client agrees to reimburse Center Parcs for any non-recoverable internal and/or third party charges arising as a result of any cancellation, eg without limitation training, consultants, entertainers, purchase of supplies, etc.
14 days or less prior to the event:
If you have to cancel or make any reduction to your final numbers, the cancellation fee will be 100%.  This represents a genuine pre-estimate of Center Parcs' loss in such circumstances and is not negotiable.
In the event of cancellation, the deposit already paid will be set off against the cancellation changes.
In cases where numbers are reduced, the cancellation charge paid will be deducted from the Final Invoice.

6. Alterations, amendments or cancellation by Center Parcs
6.1 Center Parcs reserves the right to change the accommodation or other facilities or services included in the Contract for others of reasonably equal suitability without prior notice and without any alteration in price. 

6.2 If Center Parcs has to make any alteration it will use its reasonable endeavours to provide an alternative of equal or higher standing.

6.3 No compensation shall be payable in the circumstances described in clauses 6.1 and 6.2 above. 

6.4 If Center Parcs cancels the Contract for a reason other than as set out in this Agreement, then it will use its reasonable endeavours to provide alternative accommodation, facilities and/or services to the Client at another date or another of its Villages, subject to availability.

6.5 Should Center Parcs be unable to provide substitute accommodation, facilities or services of an equal or higher standard to that contracted for, an alternative may be provided which is not of equal or higher standing in which case a reasonable reduction shall be offered.
If such a reasonable reduction cannot be agreed then the client may cancel the booking or the relevant aspects of it, where upon Center Parcs shall refund the price paid or if appropriate, a reasonable proportion part thereof.

6.6 Center Parcs may cancel the booking at any time and without liability to the Client if:
i) Subject to the provisions of clause 3.4(b) above payment of the Deposit invoice or any invoice is more than 28 days late;
ii) The Client becomes insolvent or bankrupt or goes into liquidation or has an administrator or administrative receiver appointed over its affairs, or is unable to pay its debts as they fall due;
iii) Any part of the relevant Village or any services/facilities provided are closed or not available at the relevant Village for any reason beyond Center Parcs' control;
iv) There is a failure of external services to Center Parcs such as but not limited to gas electricity or water.

7. Prices and Payments

7.1 All relevant prices include VAT at the appropriate rate. Center Parcs has the right to increase or decrease prices in line with any change in VAT or any other dues or fees levied on any part of the Contract.

7.2 The Client agrees to pay Center Parcs for any extra goods or services provided at the request of the Client or any guest or person representing the Client who is being provided with any of the events facilities or services contracted for, at any time including whilst at the relevant village.

7.3 Payment may be made by BACS, cash, cheque, bankers' draft or such credit cards as are accepted by Center Parcs from time to time.

7.4 All sums payable under the contract are due for payment 28 days after despatch of the relevant Invoice by Center Parcs to the Client.
In the event of any query relating to any Center Parcs invoice, the Client must notify Center Parcs in writing within 7 days of the Invoice issue date. 

7.5 Center Parcs reserves the right to charge interest at a rate of 2% above the base rate of National Westminster Bank Plc, on any outstanding balance(s) due to it from the Client.

8. Licensing and Statutory Controls

8.1 The operation of Center Parcs' Villages is subject to statutory controls, including those relating to fire, licensing, entertainment, safety of equipment, and all of which must be strictly observed by the Client and its delegates, guests, visitors and other invitees.  This includes but is not limited to closing/end times for functions and restaurants.

8.2 The Client is responsible for complying with Center Parcs' Health & Safety Policy, at all times during the term of the Contract.  A copy is available from the Corporate Events Office and should be inspected.  Copies will be provided on request.

9. Outside Services

9.1 The Client must obtain the prior written consent of Center Parcs for any entertainment or services contracted for by the Client for performance at/during/in connection with the Contract.  Center Parcs reserves the right to object to or refuse access to or to evict any photographer, toastmaster, speaker, band, musician, entertainer or other person employed or contracted or used by the Client in connection with a Contract.  The Client must ensure that any band, musician or entertainer or any other person employed or contracted or used by them complies with all relevant legislation, including the requirements of the Performing Rights Society and Phonographic Performance Limited.

9.2 The Client must obtain the prior written consent of Center Parcs for any display/matter/or other items to be fixed to or displayed at Center Parcs property. Fixtures and/or fittings and all such display matter/or other items must comply with legislation, codes of practice and equivalent provisions and requirements.

9.3 The Client, if employing, contracting for or using the services of a contractor/ entertainer or similar person, hereby agrees to indemnify Center Parcs against any loss of or damage to property or death or illness of or injury to any persons and against all direct and indirect claims, demands, proceedings and damages arising as a result of such employment, and/or contracting and/or use unless resultant from the negligence of Center Parcs.

9.4 Any contractor working for or with the Client in any capacity must comply with Center Parcs Standard Conditions of Work for Contractors and Center Parcs Permit to Work systems.  Such contractors must report to the Center Parcs Technical Services department before carrying out any work or services at the relevant Village and must comply with any reasonable request of Center Parcs in respect of such works and services.

9.5 Center Parcs may in its absolute discretion refuse access to any contractor if reasonable in all of the circumstances.

10. Liability

10.1 In all cases, except personal injury or death, Center Parcs liability to the Client for the total of all claims arising out of the Booking and any resultant contract is limited to the total cost of the Booking/Contract less any cancellation or other charges.

10.2 Center Parcs is not liable in any circumstances for any consequential or economic loss arising out of any contract.

10.3 The Client will indemnify and keep indemnified Center Parcs from and against any and all direct and indirect loss, damage, costs, claims, demands or liability (whether criminal or civil) arising out of any injury or other loss to Center Parcs, its employees, guests or agents unless Center Parcs is liable for the same under clause 9.3 or 10.1 above.

10.4 The Client is responsible for any and all damage caused (including but not limited to the accommodation, function rooms, furnishings, utensils and equipment in them) and resultant from any act, default or neglect of the Client its employees agents contractors delegates guests and/or visitors.  The Client shall pay to Center Parcs the amount required to make good or remedy such damage together with any other sum paid by Center Parcs in such respects including for compensation on presentation of an invoice from Center Parcs for the same.

11. General

11.1 The Client is responsible for ensuring that all of their delegates, guests and contractors and other persons involved in the Contract and not provided by Center Parcs comply with the "Our Agreement with You" and in particular with those clauses relating to behaviour and consideration towards other guests.  Attention is drawn to the fact the Center Parcs Villages are used by families with children of all ages.

11.2 The use of all activities and facilities not detailed in the Contract is subject to "Our Agreement with You" and any other specific conditions agreed at the time of booking the relevant activity or facility.

11.3 Any contractor employed by or for the Client to provide services during the term of the Contract must have:
1) a comprehensive third party liability insurance policy with a minimum cover per claim of £5 million, and
2) employers liability insurance of at least £5 million.

11.4 No beverages, wines, spirits or food may be brought into any function rooms made available at the relevant Village by the Client, their delegates, guests or other persons for consumption on the premises.

11.5 Unless stated in the contract Center Parcs' name, trade marks, publicity material and details must not be used in any advertising or publicity or for any other purpose without the express prior written consent of Center Parcs.

11.6 This Contract may not be assigned by the Client without the prior written consent of Center Parcs, but may be assigned by Center Parcs.

11.7 Should the Client make the Booking using an agent, the agent acts in that capacity for the Client and not for Center Parcs.  The Client accepts full responsibility for full payment for any Contract made in this way and for payment of the agent's fees.

11.8 Any notice or invoice hereunder shall be duly served on either party if delivered to their address as last notified in writing or facsimile to the other party hereunder. 

11.9 This Agreement is subject to English Law and the non exclusive jurisdiction of the English Courts.

11.10 Time is of the essence for the payment of sums due from the Client in respect of this Agreement.

11.11 In complying with clauses 9.4 and 11.1 the client is hereby authorised to provide a copy of the relevant Center Parcs materials to employees, agents, contractors, delegates, guests and other persons provided that they are not amended in any way and they carry a clear copyright notice as follows:

Our agreement with you

General issues

1 Our agreement with you binds you and all members of your party, including children and any day visitors. It is your responsibility to ensure that you and all members of your party are aware of, and accept the whole of this agreement and the obligations contained in it. It is effective from the date our agreement is formed and continues until the last member of your party has left your chosen Village (and includes any extensions of time to your booking).

2 Our agreement is formed when you have received our agreement with you or have accepted it online, we have received the required payment and your credit or debit card payment is authorised or,
~ your first or only postal payment has cleared through our bank, or
~ we receive sufficient gift vouchers at our office.

3 Our agreement incorporates the entire contents of the current 2005 brochure, the Confirmation and the copy of this agreement. You must also note and comply with all guidance we provide and other requirements we notify to you:
~ in our "Inside Guide" and "Safety Guide" booklets,
~ on notices,
~ on the TV (Channel 6) provided in your accommodation,
~ supplied when making a reservation, booking/taking part in activities or using any facilities during your stay, and
~ in any other information supplied by us to you.

4 Our agreement is governed by English law and we agree to the non-exclusive jurisdiction of the English Courts. We must both act reasonably in selecting or agreeing any jurisdiction including any forum for dispute resolution.

5 Should any part of our agreement be deemed by law to be void, the remainder of this agreement will, if capable, continue in full force and effect.

Before You Book

All Bookings

6 We have the right, at our sole discretion, to refuse to confirm any booking, and obtain the name, age and gender of each member of your party before confirming your booking or at any time.  You must provide us with full details of the make up of your party prior to your arrival.  Failure to do so may result in access to the Village being delayed or even denied where the terms of this agreement may not have been met.

7 We have the right to cancel your booking, or to instruct you or your party to leave the Village immediately, without compensation or refund should you or any of your party not comply with this agreement particularly where the rules and regulations relating to behaviour and conduct have not been complied with, or where you or any member of your party have been asked to leave any of our Villages on a previous occasion.

8 You must be over 21 to make a booking.

9 There must be at least one capable and responsible adult over the age of 21 in every unit of accommodation. They and you are responsible for the behaviour of all members of your party, particularly those under the age of 21.

10 You may not have the majority of persons in any unit of accommodation aged between 17 and 21, or have insufficient capable and responsible adults over 21 in each accommodation unit.

11 All female or all male parties must apply in writing before a booking can be confirmed. Stag and hen parties are not permitted.

12 The members of your party and the allocation of guests in all accommodation must remain the same for the whole of your stay, even where your stay is extended.

13 The maximum number of guests in each accommodation unit (as stated in this brochure) must not be exceeded. If it is we may accommodate those additional persons in another accommodation unit, and will charge you or them the appropriate full charge for that additional unit of accommodation for the whole of the relevant holiday period

14 You may not bring or use any shotgun, knife, firearm, air weapon, archery equipment, fireworks (including sparklers), illegal substances or similar item to any Village under any circumstances.

15 Should you wish to use a Center Parcs holiday as a gift, prize, part of a reward programme or other promotion you must contact the Center Parcs' Marketing Department at the address shown below before making your booking. They will detail the special requirements that will apply. By booking you will be deemed to have accepted our special requirements as notified to you.

16 You may not advertise, use, gift or resell your holiday (for profit or otherwise) or use it in connection with a competition, promotion, business, and charitable or any other similar venture without our express written permission.

17   If any member of your party has, or has just had, an infectious or contagious medical condition we have the right to:
~ refuse to accept your booking, or
~ cancel your holiday, or
~ ask any member of your party to refrain from participating in certain activities, or
~ ask any member of your party to leave the Village immediately, should we, at our reasonable discretion, consider it necessary to protect the health of other guests, staff or the general public.
You should inform us immediately should any such condition develop within 4 weeks of your arrival date or during your holiday.

18 Military and other aircraft fly over our Villages. Such activity is beyond our control.  

Organisations and Institutions
19 Where a party or a booking is to include members from an organisation/institution/ similar body or those benefiting from activities organised by third parties, for example, charities, local authorities and the like, you must tell us the following before we can confirm your booking:
~ the name and type of organisation/institution etc,
~ details for the contact person wishing to make  the booking,
~ any other information we may reasonably require, and you must confirm that where the majority of the party is under 21 or have special supervision requirements or are likely to do so  that there will be at least two capable and responsible adults over the age of 21 in every accommodation unit. 

20 You must provide the following information prior to arrival and confirm it on arrival: 
~ a completed rooming list or registration form for each accommodation unit, showing the names of the capable and responsible persons referred to above, 
~ the name of one capable and responsible person over the age of 21 who must be present for the duration and accept overall responsibility for the whole party. 

Guests With Restricted Mobility, Special Needs or Care Requirements

21 We welcome guests with restricted mobility, special needs or care requirements, however it is important that we are fully appraised of any needs, requirements and conditions prior to any booking being concluded.  Please ring our Special Needs staff on 01623 872 998, who will be happy to discuss availability, suitability and potential reasonable adaptations with you to establish if your needs can be met before any booking can be made. 
For guests with restricted mobility:
~ a number of adapted accommodation units are available 
~ there are special arrangements for access to the Village facilities and parking,
~ standard wheelchairs are available on a pre-booked basis and subject to a refundable deposit 
~ motorised wheelchairs and specially adapted cycles are available for hire on a pre-booked basis
For guests with special needs or care requirements (other than for family groups) it may be necessary, for example, that: 
~ the relevant guest should be accompanied on a one to one basis by a suitably qualified or experienced adult carer, and/or
~ at least one carer per accommodation unit may be necessary who is competent and qualified to administer appropriate medication and first aid as needed by the person(s) with special needs, and/or
~ the  person should be able to communicate their name and accommodation number or carry some means of identification and their accommodation number with them at all times, when not accompanied by a capable and responsible adult (see 10 above)
Please note that we rely on the information you provide. You must update us with any change in circumstances.

22 Please note that whilst our Medical Centres provide general first aid and medical assistance we cannot provide routine or special assistance to guests in respect of their special needs. There must be someone in the party capable of administering any routine or emergency medication.  Please see 61 concerning disposal of clinical waste.

Credit and debit card payments

27 For payment by credit or debit cards 1% of each or the overall amount received from you is paid to Center Parcs Card Services Limited for processing the transaction. The balance of 99% is payable to Center Parcs
Limited. Payment by debit card does not incur any additional charge.
Payment by credit card incurs an additional charge of 1% of the total amount due, also payable to Center Parcs Card Services Limited.  Making your payment by debit or credit card confirms your acceptance of these
arrangements. 

28 Credit and debit cards will normally be authorised and charged to your account the same day or the next working day. No receipts will be sent.

Taxes and Energy Charges

34 All relevant prices include VAT at the appropriate rate. We have the right to increase or decrease prices in line with any change in VAT or any other dues or fees levied on your holiday.

36 The price shown includes a separate charge by Center Parcs Energy Services Limited of £25 in respect of your gas and electricity usage at the Village throughout the duration of your break.  

Whilst on the Village

44 Our aim is to provide a relaxed holiday suitable for families in a natural environment. To ensure the maximum enjoyment of your holiday and that of all our other guests we require you to comply with all the conditions in this, our agreement with you, but draw your particular attention to paragraphs 45-61 below and to the Safety Guide you will receive on or before arrival.

45 Failure to Comply/Behaviour

Your behaviour should not be excessive, noisy or disruptive, especially at night. Offensive or illegal behaviour will not be tolerated and may result in the police being involved.  We may ask you and/or any member of your party to leave immediately if your conduct is considered by us to be inappropriate, likely to cause harm, or impair the enjoyment, comfort or safety of your neighbours, our other guests, staff and the general public, or is likely, in our belief, to breach any of our agreement with you. No refunds or compensation will be given in these circumstances.  We have the right either during or after your stay to recover from you, either by debiting the credit or debit card used to pay for the holiday or otherwise, the costs of:
~ any compensation we may pay to others, including our other guests, and/or
~ any property or accommodation damage, and/or
~ any other charges, fees or levies we may incur resulting from your action or inaction and from any breach of our agreement with you.

46 Important Information & Updates

Important information, guidance and updates will be published on the TV (channel 6) in your accommodation and you should check for such information regularly.

47 Access to the Village & Parking

Guests' vehicles may not be used or parked within the Village itself unless:
~ you are registered disabled, have booked specially adapted accommodation and make this known at the time of making your reservation and at the Arrivals Lodge/Drive-Thru on arrival - in such cases you will be allowed to park your vehicle in the designated parking place at your accommodation unit (but not anywhere else on the Village), or
~ you are using your vehicle to unload/load your luggage at your accommodation on arrival and departure only. It must be returned to the car park provided immediately after loading/unloading.
Please at all times:
~ give way to pedestrians and cyclists, 
~ keep to the left and to the speed limit,
~ drive, manoeuvre and park carefully.
All vehicles that are not parked in the specified parking areas may be towed away by us. We will charge you for doing this. We do not accept any liability for damage arising out of this operation unless due to our negligence or that of our subcontractors. 
Sleepers, boulders, logs and posts are placed to prevent roadside damage and illegal parking. No liability is accepted for any damage caused by these markers unless due to our negligence.
Access is required for Center Parcs', our contractors'/ suppliers' vehicles and other vehicles we authorise such as emergency services.
There are restrictions on the access and parking arrangements for larger vehicles at each Village. Please contact Reservations prior to arrival for details.

48 Child Protection

It is our policy to investigate any incident or allegation of concern about a child in our care or staying at one of our Villages and to refer the matter to an appropriate external organisation should we, in our reasonable and sole discretion, deem it necessary.

49 Photography

Photography (still, digital and video) is not permitted in any changing areas within the Villages.  Only non-intrusive photography of your own party and friends is permitted in the Subtropical Swimming Paradise/World of Water and other parts of the Villages.  You may not carry out photography for commercial purposes, publication or similar purposes in any part of our Villages. See also 76 on page 65.

50 Children's Supervision & Parental Responsibility

See 10 above.  You are responsible for the supervision of all members of your party under the age of 21. You must supervise your children and babies at all times unless a child is participating in an activity supervised by us such as the Time Out Club. This is particularly important in all children's play areas, in licensed areas, close to lakes and waterways, whilst cycling and in the swimming pools, where specific supervision ratios apply. These are displayed in our "Inside Guide" and "Safety Guide " booklets and on notices. 
You must collect your child(ren) from supervised activities at the appointed time.

51 Clothing

Appropriate clothing and footwear should be worn at all times, e.g. shirts in the Plaza, all main buildings and public areas and swimwear in the swimming pools with the exception of the "natural choice" sessions at the Aqua Sana.

52 Dogs

Only one dog is permitted per designated dog villa/lodge and only if you  comply with the requirements set out below.  
You must:
~ as a minimum, ensure your dog has a current annual vaccination for distemper, canine hepatitis, leptospirosis and parvo virus, 
~ keep your dog on a leash at all times when outside of your accommodation,
~ ensure that your dog only uses the dog toilets provided and does not foul elsewhere,
~ not take your dog (unless a Guide Dog) into any of the public buildings, 
~ not allow your dog to lie on furniture or beds, and
~ ensure that it is properly supervised, is not dangerous or it does not cause a nuisance or threat to other guests, our staff or the general public.
If we, in our sole and reasonable discretion, consider your dog to be dangerous or to be causing a nuisance, harm or threat to other guests, our staff or the general public, or to be likely to do so, we may:
~ ask you to remove it from the Village (without refund or compensation) or
~ have it removed to kennels at your expense.
No other pets are permitted.

53 Legislation & Licensed Premises

We may not serve or sell alcohol to anyone under the age of 18, or who appears to us to be under 18. Please do not allow any member of your party:
~ who is under 18 to attempt to buy and/or drink alcohol at any of our outlets, or to use gaming machines, or to attempt to buy and/or use any solvent based products
~ who is under 16 to attempt to buy cigarettes or tobacco or tobacco based products
~ to purchase alcohol, cigarettes or tobacco or tobacco based products for anyone who may not purchase it themselves.
We reserve the right to refuse to serve alcohol to anyone should:
~ they not prove their age to our satisfaction, or
~ in our sole discretion we consider that they have been drinking excessively.
We will accept police approved identity card schemes such as "Prove It"or a passport or new-style driving licence as proof of age.

54 Messages & Deliveries

Limited facilities exist for taking messages. We will act reasonably to assist but cannot guarantee any time of delivery. You are responsible for checking for incoming messages or post. Further details on message collection are available from the Information Centre/Guest Services Desk.  We cannot accept any deliveries on your behalf from shops and do not accept responsibility for postal or parcel deliveries unless we have been negligent.

55 Natural Inhabitants
Please note and remember that our Villages are in a forest setting that is the natural habitat of a variety of native creatures such as snakes, insects, spiders, rodents and ticks. You should note any information and guidance provided on snakes and ticks in our "Inside Guide" and "Safety Guide" booklets. 

56 Property and Environment

Please:
~ keep to prepared roads, paths and tracks at all times.
~ respect the environment, plants and animals.
~ treat all property and facilities carefully and appropriately.
Do not walk or allow children (or your dog) onto areas of newly sown grass or shrubs or into areas fenced or marked as not for access. 
Certain areas designated as nature reserves may not be accessed at all and some only with a Forest Ranger.

57 Safety

You must obey the speed limit on the Village.
Cyclists must give way to pedestrians.
It is recommended that appropriate safety helmets be worn when cycling, especially by children.
Do not use a scooter, cycle, skateboard or rollerblades in any building or Village Square/Centre.
Boating activities are only permitted on the designated Watersports Lake using Center Parcs' own equipment.
Diving, paddling, and swimming in the lakes or waterways is not permitted.
Diving is not permitted in any part of the swimming pools.
Do not enter or attempt to use any facility that is closed.
You may only use manufactured slow-burning logs, available in the Parc Market, in accommodation fireplaces or stoves.
Dispose of cigarette stubs or matches with care using appropriate cigarette bins.
Do not throw cigarette stubs or matches on the ground, especially in forest areas or in planted areas.
Barbecues are not permitted in apartments or at all during periods of risk of forest fire. You will be advised during your holiday if this is the case.
Do not light or do anything to cause a fire in the forest/woodland areas.
You are required to follow any additional safety advice given by our staff from time to time.
Fireworks (including sparklers) may not be brought or used on our Villages at any time.

58 Security of your property

We will offer reasonable help to assist you in tracing lost items. 
We draw your special attention to the following:
~ your personal belongings are your own responsibility during your holiday with us. The Police have notified us that personal cycles are particularly vulnerable in the nation-wide problem of cycle thefts. If you choose to bring your own cycle we strongly recommend that you follow the security measures listed in the Before Arrival - Don't Forget section of "Inside Guide" and obtain adequate insurance for it. 
~ any vehicle parked on our property is subject to very limited security cover only. You must lock your vehicle securely and remove all items on parking.
~ we accept no liability whatsoever for any accident, loss or damage to your property unless such loss, damage or accident is demonstrably due to our negligence or that of those for whom we are legally responsible,
~ security boxes are available at the Information Centre at all Villages (except Oasis Whinfell), at the Lakeview Hotel at Elveden Forest, in some villas at Longleat Forest and in all lodges at Oasis Whinfell.
~ the personal insurance shown on pages 62/63 of this brochure.

59 Smoking policy

We regularly review our smoking policy to ensure that it accords with all legal requirements, addresses health & safety issues and suits the preferences of the majority of our guests. Currently, smoking is not permitted in many indoor areas, particularly the swimming pools and in some or all of our restaurants. Arrangements vary between Villages. Please telephone your chosen Village for more details.  

60 Accommodation 

You are expected to use your accommodation and its contents with care and are responsible for any and all damage caused to them. An inventory of your accommodation is available in advance on request. 
On departure you should leave your accommodation in a clean and tidy condition. We reserve the right to charge you for any extra cleaning or missing items. 
We reserve the right to enter your accommodation at any time for any reasonable purpose, for example, to make checks, or carry out essential inspection, maintenance work, housekeeping or repairs.

61 Waste Disposal & Clinical Waste

For domestic waste use the litterbins and bottle banks provided. Sharp objects or broken glass which could cause personal injury should be carefully wrapped and placed directly in the large bins close to your villa. 
No other types of waste may be placed in bins. 
Please contact the Medical Centre to arrange for disposal of clinical waste and needles. 
If you are unsure about disposing of any other waste please contact the Information Centre/Guest Services Desk. We may not be able to dispose of all types of waste. 
Activities and Facilities 

62 As all activities and facilities are booked on a "first come - first served" basis we cannot guarantee that you will be able to book for a particular time or at all.
 
63 All activities and facilities (including those included in the holiday price) are subject to availability and no compensation will be payable where activities and/or facilities are unavailable or fully booked except where paragraph 74 applies.

64 Activities not included in the price of your holiday may be booked once you have arrived at the Village. Some events/activities (including selected Aqua Sana Spa sessions and treatments) may be booked before your arrival using the "Planning Your Stay" booklet that will be sent to the person named on the Confirmation. 

65 You must ensure that any activity or facility selected is suitable for those of your party who are taking part.

66 Separate agreements will be formed between us for use of facilities or participation in activities not included in the price of your holiday, and special conditions may apply. These will be notified to you in the "Inside Guide" booklet, or on leaflets or notices at the time of booking the facility or activity.
Any information or guidance provided to you before or during your participation in any activity or use of any facility must also be complied with.

67 Information on age restrictions included in the "Inside Guide" may change from time to time, and may vary between our Villages. We will not accept activity bookings from children under 8, and only from children under 12 at our discretion. Children over 8 making bookings will be deemed to have their parent or guardian's and your consent to book and participate in the activity concerned and that their participation in the activity is suitable for them.

68 Some activities/facilities require a minimum number of participants or other criteria to be met to proceed. Should we cancel an activity or close a facility in these circumstances we will refund all monies already paid for the relevant activity but will not pay any compensation as a result.

69 As some activities take place out of doors they are provided subject to appropriate weather conditions prevailing at the time your booking is to take place.

70 Some activities are supplied by subcontractors to Center Parcs, and/or take place outside the Villages.

71 Facility and activity opening times shown in the "Inside Guide" booklet are an indication only and may vary from time to time. Precise times can be obtained from Channel 6 on the TV in your accommodation or the outlet concerned during your stay.

Restaurants, Food & Beverages

72 Food, beverages and other supplies described in menus and other communications with you are provided on a subject to availability basis and are not guaranteed.

Village and Accommodation Improvements & Maintenance

73 As we continually strive to improve accommodation and facilities on our Villages and comply with any new Health & Safety legislation or other legal requirements you may find that:
~ new facilities are on offer,
~ listed facilities are temporarily closed for maintenance and/or improvement,
~ some facilities have been altered,
~ there is development or refurbishment work going on in certain areas of the Village.
~ maintenance work or housekeeping tasks are undertaken in and around your accommodation during your stay, although in such circumstances we try to minimise any inconvenience. 
~ different equipment is provided to that described in our brochures or other communications.

Unavailable Facilities

74 If we are aware in advance that:
~ the Subtropical Swimming Paradise/World of Water will be closed or
~ we are unable to provide a significant number of the facilities (i.e. more than five) in which the listed activities take place we will notify you as soon as possible. 
Should there be, as a result, a material impact on your holiday, we will offer you the following options, subject to availability: 
~ change your holiday start date, 
~ cancel your holiday,
~ change to another UK Village, or
~ continue with your holiday.
No cancellation charge would be payable in these circumstances. The full published price for your holiday date will be payable.  Should you elect to visit at the original time we will offer you reasonable compensation for this inconvenience.

For Your Information

75 Your contract is with Center Parcs Limited which operates as agent of Center Parcs (Operating Company) Limited and Center Parcs Energy Services Limited.

76 We regularly take photographs and videos for promotional and training purposes. Should you not wish to appear in any such material please notify us on or before your arrival at the Village.

77 All the information contained in our bookings is held on computer for which we hold a valid notification under the Data Protection Act. By providing us with the information required for booking and otherwise you are deemed to accept the above and to have gained consent from the members of your party to disclose their details to us.
We collect and keep information about you for the following reasons:
~ tailoring our service to your requirement and preferences,
~ conducting market research surveys
~ providing you with information about our product and services and those of carefully selected third parties.
If you do not wish to be contacted by us for any of these purposes please write to the Center Parcs Marketing Department, One Edison Rise, New Ollerton, Newark, Nottinghamshire NG22 9DP
We will not sell this information and will only disclose it to other companies within our Group and to suppliers we engage to process data or provide services on our behalf.

78 We use CCTV cameras at some locations at all of our Villages for the purposes of crime prevention and public safety. The scheme is controlled by Center Parcs Limited. For further information contact the Security Manager of the Village concerned.

79 To ensure that standards are maintained we may record or monitor calls to our offices.

80 We have done our best to ensure that the information in the brochure was correct when it went to press in December 2005.

Liability

81 In all cases, except personal injury or death, our liability to you for the total of all claims arising out of your holiday with us is limited to the cost of your booking less any insurance, cancellation and amendment charges.
We will not be responsible for any matters that result from any unforeseeable and unforestallable events that are beyond our control.

82 Any claims in respect of any separate activities you book will be dealt with on an individual basis in accordance with the separate contracts which will exist between us for any such activity.

Can We Help?

83 We always aim to give prompt assistance to you if you are in difficulty.

84 Any concerns or assistance you require should be brought to our attention immediately. We will try to respond promptly to any concerns you raise so that you can continue to enjoy your holiday. Please help us by reporting any damaged or out of order facilities as soon as possible. 
For Village shops, restaurants and activities please contact the manager of the outlet concerned.
For accommodation, any other areas or any unresolved matters please contact the Information Centre.

85 Please note we are not responsible for any matter of which you were aware and which you did not bring to our attention during your holiday.
Any reported matter which has not been resolved during your holiday should be advised in writing to the General Manager of the Village concerned (see addresses on back cover of brochure) within 28 days of the end of your holiday.
